General Information
These general terms of use define the legally binding terms that apply to the use of Laurea-ammattikorkeakoulu Oy’s (“we” or “Laurea”) online store and to all content of the online store.
The user of the online store (“you”, “customer”, “business customer”, “private customer”) must accept these terms before starting to use the online store. By registering in the online store, you accept the terms. If you do not accept the terms, do not use the online store or register for it.
We reserve all rights except those expressly granted in these terms.
Content And Use Of The Service
In the online store, we offer educational content and supporting services. The online store is intended for private and business customers. We do not guarantee that the online store will be available on all devices. The content, schedule and total price of the online store education product are described in connection with the product purchased from the online store.
As a user of the online store, you are responsible for acquiring the necessary equipment and communication connections for the course, as well as for all costs and expenses arising from them.
The right to study is user-specific. The right to study the course starts when you have paid for the course and/or the course has been activated with a separate electronic notification delivered to you. There are no additional costs for you for the delivery of electronic products. After registration, you will receive instructions for activating your user ID and starting your studies.
You get study rights for the courses you are registered for or for which you are entitled according to your student profile. The right to study is determined by the duration of the education.
These terms govern the use of the online store. By registering in the online store, you accept the terms and conditions and:
- You agree to provide truthful, accurate, up-to-date and complete information about yourself during the registration process;
- You agree to be responsible for keeping your login information (including password) in a secure manner;
- You undertake to keep up-to-date and promptly update the information you provide during registration so that it remains true, accurate, up-to-date and complete. Contact information is updated by contacting customer service; and
- You agree that if the information you provide is untrue, inaccurate, out of date or incomplete, or if we have reasonable grounds to suspect that the information is untrue, inaccurate, out of date or incomplete, Laurea has the right to close your user account and prohibit your current and future use of the online service.
Conditions for studying at an open university of applied sciences
A temporary study right is granted for studies at an open university of applied sciences. In addition, the following conditions apply to studying at an open university of applied sciences:
- If your studies take longer, contact customer service.
- If you want to continue your studies at an open university of applied sciences, you must register for the next semester’s studies through the online store.
- If you have paid the annual fee of an open university of applied sciences, you will be entitled to study for one year from the date of registration. Otherwise, the right to study at an open university of applied sciences is determined for the semester in which the educational product is realized. Path students of the open university of applied sciences receive the right to study for two semesters. The right to study on a path starts at the beginning of the semester either on January 1. or 1.8.
- Path studies at the open university of applied sciences must be completed during two semesters. If a path student does not complete 60 credits during the path study year, he can accumulate the missing credits by choosing studies from the open university of applied sciences’ study offer and paying the new open university of applied sciences tuition fee (per credit or annual fee). If there is a delay in the completion of the pathway studies, the pathway student cannot continue his studies with the group in which he was initially placed.
- As a student at an open university of applied sciences, you must complete your studies during your right to study. If the completion of the study is prolonged due to a re-examination or a grade upgrade, your right to study can be increased to complete the re-examination or upgrade. The student is not entitled to complete other studies during the extended period of the right to study.
- Registration for open university of applied sciences courses is always done using the registration method and time specified by Laurea open university of applied sciences. Students of the generally open university of applied sciences are accepted in order of registration.
- Laurea’s degree students cannot register as students of the open university of applied sciences of their own university of applied sciences or for implementations whose target group is only students of the open university of applied sciences. Degree students with Laurea’s absent attendance mark cannot register as students of an open university of applied sciences. During the period of absence, no achievements can be recorded in the student’s record register. With the study fee for the path studies, you can also study individual studies of the open UAS from the offer targeted at the students of the open UAS.
- As a student of an open university of applied sciences, after registration you will receive instructions for activating your Laurea username and accessing Laurea’s systems. You must be present at the first contact time of the training or notify the teacher in charge of your absence. Alternatively, the teacher can also determine another way in which you can confirm your participation in the implementation as described in the degree regulations. Registration will be rejected if you do not report your absence at the start of the training. If prior competence has been defined for completing the training, you must, if necessary, demonstrate this competence to the teacher in charge before the start of the relevant training.
Access Rights And Intellectual Property Rights
We grant you a limited, revocable right to use the online store under and in accordance with these terms. You do not have the right to transfer, further license, forward or or otherwise distribute the rights that belong to you under these terms. The activation links or coupons purchased by the business customer are valid for a maximum of one year. We do not refund coupons that are not redeemed.
All intangible rights, including copyrights, related to the online store and the information, functions, education and other content contained therein belong to Laurea or third parties. You may not change, modify, delete, copy, describe, publish, translate into a foreign language, distribute, make available to the public or transfer any items protected by intellectual property rights belonging to Laurea or others in the online store’s content and otherwise infringe the intangible rights belonging to Laurea or others.
Restrictions On Use
You do not have the right to:
- Copy, duplicate, perform, publicly transmit, forward or otherwise use any part or part of the online store, course or content in a way that is not expressly permitted in these Terms of Use;
- Provide a password to a third party or use another person’s username or password;
- Use the service in a manner that violates these Terms;
- Artificially circumvent limits affecting pricing or otherwise manipulate the online store; or
- Uses the online store for an illegal or immoral purpose or otherwise damages, destroys or overloads the online store.
In addition to the above, you undertake to make reasonable efforts to ensure that the online store and its content are not used without permission.
Terms Of Delivery And Payment
The features and up-to-date prices of the products for sale are presented in connection with the product presentation of each product.
The education is paid using the payment methods available in the online store. Laurea does not store bank connection or credit card information. However, if you wish, you can save the credit card information in the customer profile of the online store. If the amount of the order exceeds the payment methods enabled by the online store, we will send you an invoice. The prices are stated in euros. Laurea is liable for VAT. Prices include 24% value added tax. Some of the courses are VAT-free (VAT 0%).
Paytrail Oyj (2122839-7) operates as the payment intermediary service provider and in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the recipient of the payment on the bank statement or card invoice and forwards the payment to the merchant. Paytrail Oyj has a payment institution license. Information about the payment transaction is transmitted using an encrypted connection, and outside parties do not have access to the information. The transaction is created between the customer and Laurea. Laurea is responsible for all obligations related to the trade. The training is considered to have started according to the start date indicated in the course information. The teaching of online studies is considered to have started when you have received the instructions for starting the studies. A negative support decision from the TE office or a degree or pathway study place at another university of applied sciences does not entitle the student to a refund of the study fee. Case-specific cancellation conditions apply to larger course modules, continuing education or specialisation training.
Laurea can offer coupons in connection with the use of the online store. Unredeemed or unused coupons will not be refunded.
Processing Of Personal Data And Other Data
The service uses personal data in accordance with the law and other data protection regulations to implement the service. More detailed information is provided in the privacy policy of the Laurea Smart online store.
Warranty And Liability
You use the online store at your own risk.
The online store and the courses it contains are offered as they are and subject to availability. You yourself take responsibility for making sure that the education you choose fits your purposes and plans. No written or verbal information given by a Laurea representative gives a guarantee that the training meets your training needs.
We take care of the functionality and availability of the online store to the best of our ability, and we strive to correct any errors within a reasonable time. However, we do not guarantee that the online store is error-free or that the online store is available without interruption. Technical malfunctions and maintenance interruptions may occur from time to time, and they may cause temporary interruptions to the online store. We reserve the right to modify and remove temporarily or permanently the functions and features of the online store as well as the products of the online store. Laurea has the right to develop and change the online store and the courses it contains. We also reserve the right to discontinue the online store or individual course at our discretion at any time. We will endeavor to notify you of such changes in advance. You are responsible for any costs that these changes cause.
The online store may contain links to websites owned and/or managed by third parties. We are not responsible for such third-party website, and the materials and content on such website are not under Laurea’s control. Laurea is in no way responsible for the transactions between the user and such a third party.
The use of the service is the responsibility of the User.
Cancellation Policy
These cancellation conditions apply to the courses included in the online store, if no specific cancellation conditions have been defined for the course.
Registration for course is binding. Enrolment takes place in accordance with Laurea’s instructions, and you are responsible for your own enrolment and the fulfillment of any prerequisites. By registering for the course, you accept the terms. Laurea is not responsible for the student’s enrolment.
Cancellation of enrolment must be done through the online store’s own account or by contacting the online store’s customer service. Cancellation of the course to the teacher or another person is not accepted. If enrolment for an open university of applied sciences education is canceled no later than 14 days before the start of classes, 80% of the tuition fee will be refunded to the student. This does not apply to continuous education, specialisation training, specialist training or path studies.
Laurea reserves the right to make changes to the course and cancel the course due to insufficient number of participants. If Laurea cancels the course paid for by the customer, the customer will be refunded the amount paid in full within seven (7) days of the cancellation of the training. The payment for the canceled training cannot be transferred. The customer must pay for the course in connection with a possible new enrolment. If the course at the open university of applied sciences is canceled and the student is entitled to a refund, the refund can be made within the semester in which the course was intended to take place.
Laurea reserves the right to make changes to the courses. At Laurea, we operate in accordance with Laurea’s common safety guidelines for courses, and an exceptional situation is not a reason for refunding the course payment. In cases of serious illness or injury, which can be proven in writing with a medical certificate, the general cancellation conditions can be deviated from on a case-by-case basis.
Limitation Of Liability
Laurea, its management and employees are not responsible for any indirect or consequential damages (including lost data, malfunctions, computer failures or financial losses) resulting from using or preventing access to the online store, or from an issue related to the delivery of the order or the product. In the event of problems related to the service, the rights of the online store user are limited to the right to stop using the online store.
In every situation, Laurea’s liability is limited to the mandatory liability provisions of Finnish law. In this case, Laurea’s total liability for damages, regardless of their nature and amount, is in any case a maximum of the price paid by the customer to Laurea for the product that caused the damage or was directly related to the damage.
Under no circumstances is Laurea responsible for delay or damage caused by an obstacle beyond our control, which we cannot reasonably be expected to have taken into account at the time of concluding the contract, and whose consequences we could not reasonably have avoided or overcome.
Termination And Other Dismissal
You can terminate your membership in the online store at any time by notifying our customer service by email. Termination takes effect when we have deactivated your account.
Laurea has the right to unilaterally terminate the membership and the use of the online store at any time from a customer whose credentials are used or suspected of being used in a manner contrary to the terms of use or otherwise improperly, or if Laurea, at its sole discretion, considers that using the online store or the education contained therein is against good practice or against Laurea’s interests. If Laurea terminates the right to study for reasons other than those mentioned in these terms and conditions, Laurea is not responsible for it to the student or a third party, and is not obliged to compensate any costs or fees that may have been incurred.
Changes To The Terms And Conditions
Laurea has the right to unilaterally make changes to these terms and conditions at its discretion. All changes made to the terms of use will be updated on this page. If the customer continues to use the online store, the customer is deemed to have accepted the changes.
Applicable Law And Settling Disputes
Finnish law applies to these conditions, with the exception of its conflict of law provisions.
Laurea tries to settle any disagreements regarding the order and the online store primarily by agreement, so please contact our customer service in the first place to settle the matter. Disputes related to the terms, the online store and its contents are handled in the first instance in the district court of Laurea’s domicile, i.e. the district court of Itä-Uusimaa.
The consumer can bring a claim against Laurea regarding disputes arising from the contract either in the district court of Laurea’s domicile or, as a consumer, in the district court of the place in Finland in which he has his place of residence. If the user does not have a place of residence in Finland, disputes are handled in the district court of Laurea’s domicile, i.e. the district court of Eastern Uusimaa.
The private customer has the right to refer disputes arising from this contract to the Consumer Disputes Board.
Before taking the case to the Consumer Disputes Board, the customer must contact the magistrates’ consumer advisory service . The customer also has the opportunity to use the online dispute resolution forum maintained by the European Commission .
Language Versions
If these terms and conditions are translated into another language and there are inconsistencies between the versions in different languages, the Finnish version is decisive and the inconsistencies are considered to be caused by a translation error.
